H1B Electronic Registration Process, March 23

In 2020 we implemented an electronic registration process for the H-1B cap. Prospective petitioners seeking to file H-1B cap-subject petitions, including for beneficiaries eligible for the advanced degree exemption, must first electronically register and pay the associated $10 H-1B registration fee for each prospective beneficiary.

The electronic registration process has streamlined processing by reducing paperwork and data exchange, and has provided overall cost savings to employers seeking to file H-1B cap-subject petitions.

Under this process, prospective petitioners (also known as registrants), and their authorized representatives, who are seeking to employ H-1B workers subject to the cap, complete a registration process that requires only basic information about the prospective petitioner and each requested worker. We will open an initial registration period for a minimum of 14 calendar days each fiscal year. The H-1B selection process will then be run on properly submitted electronic registrations. Only those with selected registrations will be eligible to file H-1B cap-subject petitions.

Selections will take place after the initial registration period closes, so there is no requirement to register on the day the initial registration period opens. Creating an online account is easy; please see the videos below.

FY 2022 H-1B Cap Registration Process Update

The H-1B cap electronic registration process was again well-received by users, who provided a high satisfaction score with the system for FY 2022 (4.87 out of 5). Registrations were submitted by more than 37,000 prospective petitioners and roughly 48% of all registrations requested consideration under the advanced degree exemption.

Per regulation, USCIS takes into account historical data related to approvals, denials, revocations, and other relevant factors to calculate the number of registrations needed to meet the H-1B cap for a given fiscal year. Based on historical data, the initial projected number of registrations required to meet the numerical limitations for FY 2022 was less than the initial projected number of registrations required for FY 2021.

For FY 2021, we received 274,237 H-1B registrations and initially selected 106,100 registrations projected as needed to reach the FY 2021 numerical allocations. We conducted a second selection in August 2020 of an additional 18,315 registrations due to low filing volume from the initial selection. This resulted in a total of 124,415 selected registrations.

For FY 2022, we received 308,613 H-1B registrations and initially selected 87,500 registrations projected as needed to reach the FY 2022 numerical allocations. On July 29, 2021, we announced that we conducted a second selection of an additional 27,717 registrations. This resulted in a total of 115,217 selected registrations. The petition filing period based on registrations selected on July 28 began on Aug. 2 and closed on Nov. 3. On Nov. 19, 2021, we announced that we conducted a third selection of an additional 16,753 registrations. This resulted in a total of 131,970 selected registrations. The petition filing period based on registrations selected on Nov. 19 began on Nov. 22, 2021, and closes on Feb. 23, 2022. Those with selected registrations will have their myUSCIS accounts updated to include a selection notice, which includes details about when and where to file.
